Вчера я отправила письмо с вопросом о документах необходимых для заключения брака с иностранцем на территории РФ. Я удивлена но уже сегодня пришел ответ.

1) Начиная от дня подачи заявления, мы будем вынуждены ждать месяц (или немного больше, на 3-4 дня) Срок ожидания может быть сокращен если женщина беременна.

2) Кроме того, согласно пункту 2 статьи 26 Федерального закона в случае, если одно из лиц, вступающих в брак, не имеет возможности явиться в орган ЗАГС для подачи совместного заявления о заключении брака, волеизъявление лиц, вступающих в брак, может быть оформлено отдельными заявлениями.

Подпись заявления лица, не имеющего возможности явиться в орган ЗАГС, должна быть нотариально удостоверена.

Таким образом, законодателем предусмотрена возможность подачи заявления о заключении брака одним из лиц, вступающих в брак при наличии нотариального заверенного заявления от второго лица.
