Основание освобождения от ответстве

Основание освобождения от ответственности имеет силу с момента его наступления или, если уведомление не было сделано своевременно, с момента подачи такого уведомления. Отсутствие уведомления возлагает на нарушившую Сторону ответственность за убытки, которые в противном случае можно было избежать.

Grounds for exemption shall have effect from the moment of its occurrence, or if the notification was not made in a timely manner from the date of such notice. The lack of notification imposes on the breaching party liable for damages, which otherwise could have been avoided.

Results (English) 2:

The basis for the exoneration is valid from the moment it occurs or, if the notification has not been made in a timely manner, from the moment of filing such notice. The absence of notification holds the infringing Party liable for damages that could otherwise have been avoided.

Results (English) 3:

The grounds for exemption from liability shall take effect from the date of occurrence or, if the notice is not given in time, from the date of notice. If there is no notice, the breaching party shall be liable for the losses that could have been avoided.
